​​​Tenure


​Tenure deals with the rights and obligations of owners of property vis á vis each other and towards the State. Matters it regulates include: right to registration, division of land, division of buildings (buildings in joint ownership), options, compulsory partition, sale of properties held in undivided shares, rights and easements, general registration – incorporation of new plans, and land consolidation. It has a number of aims and objectives, namely: restriction of the multi-fragmentation of land; abolition of dual and multiple ownership; restriction of property held in undivided shares; legislative proposals relating to modernising property tenure and introducing new concepts for tenure; replacing existing plans which form the basis of registration on scales 1:1250, 1:2500 and 1:5000 with new higher fidelity and greater precision plans on scales of 1:2000 and/or 1:1000; registration, updating and computerisation of all data and encumbrances of immovable property; and assistance in land consolidation projects.​
