The Department of Lands and Surveys informs the public that, pursuant to the provisions of the Sale of Immovable Property (Specific Performance) Law, No. 81(I)\/2011, as amended by Law No. 132(I)\/2023, the procedure for the imposition and collection of administrative fines for breaches of specific obligations will be put into effect.<\/p>

A transitional period of three (3) months is set from 16\/2\/2026 to 16\/5\/2026 for the purpose of informing and ensuring compliance by parties concerned.<\/p>

Obligations and Administrative Fines<\/strong><\/p>

1. Seller\u2019s Obligations<\/strong>
The seller is required to attach to the sale contract, a Certificate of Search of Immovable Property, dated no earlier or later than five (5) working days from the date of signing the contract.<\/p>

Failure to comply will result in an administrative fine, depending on the sale price, as follows:<\/p>

2.Mortgagee\u2019s Obligations<\/strong><\/p>

In cases where the purchaser deposits the amount of the sale agreement into the seller\u2019s bank account, the mortgagee is obliged to issue\/provide a payment confirmation and to release the immovable property from the mortgage or discharge the mortgage, as applicable.<\/p>

Failure to comply will result in an administrative fine, depending on the mortgage amount, as follows:<\/p>
