GENERAL REGISTRATION AND INCORPORATION OF NEW PLANS SECTION

This section is concerned with:

  • The gradual completion of the General Registration of immovable property across Cyprus, based on new plans of sufficient accuracy, usually in accordance with sections 43 and 45 of the Law Cap. 224,
  • The issue of decisions, on behalf of the Director, regarding objections to the incorporation of new plans, pursuant to section 50A of the Law, Cap. 224; and
  • The application of the legislation on Greek Cypriot property in the Turkish occupied areas of Cyprus with a view to the issue of temporary titles.

One of the main activities of this Section is participating in the resurvey procedures of immovable property. All branches of the Department are involved in the resurvey activity and have developed very efficient procedures, as evidenced by the fact that nearly all the published plans are accepted by the public, and the very limited number of objections submitted. This mechanism prepares, on a case by case basis, plans in selected areas where the existing plans are considered to be totally inadequate and unreliable. The resurvey project, when completed, is expected to upgrade the operations of the entire Department.

Following the addition of Part VIA to Cap. 224, any registered owner of an immovable property may apply to a District Lands Office for update of the registration of his or her property. Moreover, where a registered owner of immovable property, whose title needs to be updated, neglects to submit an application, the Director of the Department of Lands and Surveys may proceed to compulsory updating of the title, either on his or her own motion, or at the request of the competent Authority or of a person who has an interest in such property, including a purchaser who has deposited a Sales Contact at the Department. The Department, in collaboration with other Departments of the Public and Wider Public Sector, has initiated the process of compulsory updating of titles, and the Director examines requests on his or her own motion, including requests submitted by a person with an interest in a property following the approval/decision of the Director.

During the year 2021 the Department of Lands and Surveys has issued 1.700 title deeds, and there are about 18.000 pending title deeds relating to various developments. This number includes both the developments for which the updating process has been initiated by the Director on his/her own motion, upon request by a person with interest in the property, and the developments for which no action has been taken, neither by the owner nor by any other person.
