COMPULSORY ACQUISITION OF RIGHT-OF-WAY – SECTION 11Α

Who can apply:
Where a property is surrounded completely by other properties and is thus deprived of the necessary access to a public road or where the existing access is insufficient to make full use of the property, the owner may claim to obtain a right-of-way from adjoining properties upon payment of reasonable compensation.

  • Application form Ν.284
  • Approved cadastral plan (original)
  • Affidavit made before the registrar and the exhibits attached thereto* (which should state the purpose, the means and the time of services
  • Form Ν.283
  • Double registered postal forms
  • In the case of an owner who resides permanently abroad, the following documents should be submitted:
    Posting form Ν128Α accompanied by a Certificate issued and signed by the President of the Community in the boundaries of which the property is situated, which states that the owner resides permanently abroad.
  • Photocopy of both sides of the applicant’s identity card or passport or ARC (for foreigner applicants)
  • Reference of applicant’s postal address and contact telephone number(s)
  • If the application is submitted by a Proxy, either through a General Power of Attorney (fee of €50.00 for depositing the General PoA) or through a Special Power of Attorney (no fee), the Power of Attorney must be placed in the special box outside the building of the District Lands Office. The Power of Attorney must be duly stamped and the signature thereon certified.

    *All documents (N.283, Plan, Postal Forms, N128A, Certificate issued and signed by the President of the Community) may be submitted to the Court as exhibits.
    NOTE: The application must be deposited within sixty (60) days from the date of service of the Form N.283.
