RELEASE OF IMMOVABLE PROPERTY FROM MORTGAGE
Who it concerns:
Any share smaller than the mortgagor’s share in a mortgaged property or any property included in
a mortgage in which other properties of the same or other mortgagor are also contained, may be
released from the mortgage against partial payment of the mortgage debt or for any other reason.

- Form Ν.273
- Original contract and declaration of mortgage – Ν.271
Procedure followed for the release of a property from a mortgage:
- Both the mortgagor and the mortgagee must appear before any District Lands Office.
- Both the mortgagor and the mortgagee must complete and sign the Form N.273.
- Where there are any guarantors, their consent is necessary and it may be obtained either by their physical presence at the District Lands Office and by signing the Form N.273, or by providing their consent in a separate document. In the latter case, the signature of the guarantors must be certified.
- If the property is encumbered with more than one mortgage, a simultaneous release from all mortgages is required.
