ABOLITION OF RIGHT-OF-WAY
Who it concerns:
Where a new public road is constructed or any other access is created after the creation and
acquisition of aright-of-way or where for any other reason the need of a right-of-way ceases to exist
(where the dominant tenement is served in the same way and to the same extent by the public
Road or access created) the owner of the servient or dominant tenement is entitled to request the
Abolition of such right pursuant to section 12 of the Law Cap. 224.
Required Documents / Conditions / Samples:
- Application filed by the registered owner(s) of the servient tenement pdf – sample of the application
- Consent of the beneficiary of the right pdf – sample of the consent
- Where the above consent of the beneficiary of the right-of-way is not submitted and the dominant tenement is served by a public road or other right-of-way then the owner of the servient tenement may file an application for abolition of the right-of-way, which will be considered after a local enquiry is made.
- Photocopy of both sides of the applicant’s identity card or passport or ARC (for foreigner applicants)
- Reference of applicant’s postal address and contact telephone number(s)
- Σε περίπτωση που η αίτηση υποβληθεί από Πληρεξούσιο Αντιπρόσωπο είτε με Γενικό Πληρεξούσιο με χρέωση €50,00 για την κατάθεση, είτε με Ειδικό Πληρεξούσιο χωρίς καμία χρέωση, τότε η υπογραφή στο έγγραφο θα πρέπει να είναι δεόντως πιστοποιημένη. Η χαρτοσήμανση του πληρεξουσίου είναι απαραίτητη μόνο στην περίπτωση που αυτό έχει υπογραφεί έστω από έναν πληρεξουσιοδότη πριν από την 1.1.2026.
