VARIATION – FIXING OF POSITION OF RIGHT-OF-WAY

Who it concerns:
The Director of the Department of Lands and Surveys, pursuant to the provisions of section 14 of the Law Cap. 224, is vested with the power to determine or vary the position or the direction of any existing right-of-way, channel, watercourse, stream, aqueduct, pipe or any other similar right upon submission of an application by the owner of the servient or dominant tenement.
Required Documents / Conditions / Samples:
  • Application – Form Ν.252Α (Name and full addresses of all registered owners of both the servient and the dominant tenements associated with the right-of-way for which the application is made)
  • A plan printed through “DLSPORTAL” (“Interactive Maps” Service) clearly indicating/focusing on the plot(s) in question, or any other plan the applicant has in his/her possession. Printing to scale is not necessary unless the applicant wishes to do so, e.g. scale of the cadastral plan in use (this is indicated on the Title Deed) or any other. The plan should clearly indicate the requested variation.
  • Photocopy of both sides of the applicant’s identity card or passport or ARC (for foreigner applicants)
  • Reference of applicant’s postal address and contact telephone number(s)
  • If the application is submitted by a Proxy, either through a General Power of Attorney (fee of €50.00 for depositing the General PoA) or through a Special Power of Attorney (no fee), the Power of Attorney must be placed in the special box outside the building of the District Lands Office. The Power of Attorney must be duly stamped and the signature thereon certified.
