HORIZONTAL DIVISION
Who it concerns:
Horizontal division is applied in the case of apartment buildings and of single developments, by creating new titles deeds for the units (apartments, shops, etc.). The application may be filed by the registered owner(s) of the property, and in order to file the application, it is necessary to provide all the documents required below.

- secure a Certificate from the Competent Authority granting the division permit (Certificate of approval / Certificate with notes / Certificate of unauthorised works)
- secure a Certificate of Demarcation
- the necessary cadastral field survey work, that is carried out by a competent private surveyor; and
- all of the undermentioned documents/work to be submitted duly completed

- Application, Form Δ.Ε.248 (signed by all owners or by all Directors, stamped with the seal of the Company, or by a Proxy)
- Division permit (including the terms and all the approved architect’s plans).
- Certificate from the Competent Authority granting the division permit (Certificate of approval / Certificate with notes / Certificate of unauthorised works)
- Building Permit(s) (including only the terms attached thereto, without the architect’s plans).
- Certificate from the Competent Authority granting the building(s) permit(s) (Certificate of approval / Certificate with notes / Certificate of unauthorised works).
- Town planning permit(s) – if issued (including the terms attached thereto).
- Distribution agreement or Form Ν3Α, in case the original plot is jointly owned, and there is no distribution agreement filed with the Department of Lands and Surveys.
- List of the determination of shares of the jointly owned property, form Δ.Ε. 163, prepared in accordance with the Guide and the Table of calculation of shares of the jointly owned property, – see sample of completion of the Table of calculation of shares of a jointly owned property (both the form ΔE163 and the calculation table should be attached).
- Mortgagors' consents, for the substitution of mortgage entries, in accordance with the provisions of article 28 of the Transfer and Mortgage Law no.9/1965, Forms Δ.Ε. 223 and Δ.Ε. 225 as appropriate:
- Δ.Ε 223 for the pdf format, Δ.Ε 223 for the word format
- Δ.Ε 225 for the pdf format, Δ.Ε 225 for the word format
- Consents for grant of right-of-way or other easements (whether this is a term imposed by the Competent Authority or not), where applicable, form Ν251Α.
- Consents for the abolition of right-of-way or other easements (whether this is a term imposed by the Competent Authority or not), where applicable
- A private competent surveyor's report, a large-scale numbered survey plans, a list of the coordinates, a transparent slide to the scale of the current cadastral plan and a list of the areas of the proposed plots.
- A list of the details of new plots, and counterclaims to sale contracts, form Δ.Ε. 250 – see Sample – Form Δ.Ε. 250
- In cases where the division permit is not consistent with the sales contracts, a supplementary agreement between the parties, amending the SLC to make it consistent with the division permit should be provided. Otherwise, the unit's title deed shall be issued with a note to that effect.
- Maintenance of Property Characteristics Forms - Ν314Α1.
- Photographs in digital format of all three sides of the property and where possible all four sides.
- Authorisation by the Cyprus Scientific and Technical Chamber ETEK.
- Photocopy of both sides of the identity card or passport / ARC (Foreigners).
- Reference should be made to the postal / electronic address and contact telephone number(s).
- General Power of Attorney (fee of €50.00 for depositing) or through a Special Power of Attorney (no fee), in case the application is to be filed by a Proxy.
NOTES:
- In case of submission of the application by e-mail, only the application form ΔΕ 248 and the certificate of the Competent Authority granting the division permit should be sent.
- The originals or certified copies of all of the above documents should be submitted immediately after the payment of the fees, in the box outside the building of the District Lands Office, accompanied by a copy of the JCC SMART payment receipt, and if these are not submitted within three (3) days, the case shall be rejected).
