Activation of the Administrative Fines Procedure under the Sale of Immovable Property (Specific Performance) Law No. 81(I)/2011

The Department of Lands and Surveys informs the public that, pursuant to the provisions of the Sale of Immovable Property (Specific Performance) Law, No. 81(I)/2011, as amended by Law No. 132(I)/2023, the procedure for the imposition and collection of administrative fines for breaches of specific obligations will be put into effect.

A transitional period of three (3) months is set from 16/2/2026 to 16/5/2026 for the purpose of informing and ensuring compliance by parties concerned.

Obligations and Administrative Fines

1. Seller’s Obligations
The seller is required to attach to the sale contract, a Certificate of Search of Immovable Property, dated no earlier or later than five (5) working days from the date of signing the contract.

Failure to comply will result in an administrative fine, depending on the sale price, as follows:

2.Mortgagee’s Obligations

In cases where the purchaser deposits the amount of the sale agreement into the seller’s bank account, the mortgagee is obliged to issue/provide a payment confirmation and to release the immovable property from the mortgage or discharge the mortgage, as applicable.

Failure to comply will result in an administrative fine, depending on the mortgage amount, as follows:

At the end of the transitional period, fines will be imposed in accordance with the provisions of the legislation.
