COMPULSORY SALE OF IMMOVABLE PROPERTYCHARGED BY ENCUMBRANCE CREATED BY A COURT JUDGMENT (MEMO)
Who can apply:
Any judgment creditor may apply to the Lands Office of the District where the property is situated requesting the sale of the property to secure the judgment debt instead of asking for a writ of sale to be issued by the Court.
Required Documents / Conditions / Samples:
- Application for sale using the form Δ.Ε.179 (made by the judgment creditor) and attached thereto the following:
- The judgment creditor’s affidavit with the Notice to the judgment debtor attached thereto,
- proof of service of the notice
- proof of submission of the court judgement's registration or indication of file reference of its submission.
- The application may be filed after one (1) year has elapsed from the date of registration of the MEMO.
How to submit:
Acceptance of the application is made at the District Lands Office where the property under MEMO is located
