DIVISION AGREEMENT

Who can apply:
A Division Agreement is an agreement concluded between all joint owners of a plot, specifying the share as well as the part that belongs to each owner. This agreement is submitted to the Lands Office and it is legally binding for all owners and their heirs, if any.
Required Documents / Conditions / Samples:
Conditions for submitting a Division Agreement
  • The subject matter of the Agreement should be registered in the name of all parties.
  • The Agreement should be made in writing, containing sufficient details of the parties and of its subject matter.
  • The Agreement should clearly date the immovable property’s data (registration number, sheet/plan, plot, section and Municipality/Parish/Community).
  • The Agreement should be duly signed by:
    • all registered owners or
    • the Directors, in case any of the registered owners is a legal person, and it should be stamped with the Company's seal, or
    • A proxy of the above-stated provided thatat their signatures have been certified by a Certifying Officer or the Head of the Community.
  • A Cadastral or Architectural Plan or Layout Plan, indicating the division, signed by all registered owners and the signatures thereon duly certified, should be attached to the Agreement.
  • The submission of the Agreement should be done within six (6) months from the date of it was signed.
  • The Division Agreement should be duly stamped.

Required documents
  • Application Form - Form Δ.Ε.305 (duly signed by at least one or the Proxy of one of the registered owners)
  • The original Division Agreement - Sample which can be adapted/modified on a case-by-case basis.
  • In case the immovable property is registered to individuals having a distinctive number other than a Cypriot identity card, a photocopy of both sides of their identification document must be attached. For Cypriot citizens a photocopy of their Cypriot identity card is required and for foreigners a photocopy of their passport or ARC.
How to submit:
Acceptance of the division agreement is made at the District Lands Office where the property is located.
