MORTGAGE IN THE OCCUPIED AND THE NON-OCCUPIED BY THE TURKISH TROOPS AREAS OF LEFKOSIA AND LARNAKA
Who it concerns:
A mortgage means a voluntary encumbrance of a property to secure payment of an existing, future or
contingent liability. The “mortgagor or mortgage debtor” is an owner of immovable property who creates
a mortgage thereon whereas the person in whose favour the mortgage is created is called “mortgagee or
mortgage creditor”.

Required Documents / Conditions / Samples:
- Appointment arrangement form, with the option of electronic completion (in duplicate).
- Declaration - Form Ν271, duly completed by the Mortagor.
- Copy of the Identity Card/ARC/Passport of all interested parties. The original Identity Card/ARC/Passport or other evidence must be presented on the transaction day for identification purposes.
- Form Δ.Ε.307which may be completed electronically or in handwriting in case the mortgagee is being represented by a natural or a legal person. The form must be signed on the date of registration of the Mortgage.

How to submit:
For immovable property located in the non-occupied by the Turkish troops areas, the submission of the required documents should be done at the District Lands Office you wish to have the legal transaction processed. For immovable property located in the occupied by the Turkish troops areas of Lefkosia and Larnaka, the submission of the required documents should be made at the Lefkosia District Lands Office.
Once the validity and the completeness of the documents have been verified by the District Lands Office, you will be notified of the date and time of the appointment to process the transaction, either by telephone or via e-mail.

Fees / Charges:
| For the occupied by the Turkish troops areas of Lefkosia and Larnaka:
No fees to be paid for registration of a mortgage concerning immovable property located in the occupied territories |
| For the non-occupied by the Turkish troops areas of all districts: 1% on the value of the mortgage is charged for registration of the mortgage. Where an existing mortgage or mortgages are terminated and on the same day, the mortgagee creates, for the same purpose, a new mortgage with the same mortgagor, but in respect of another property or other properties, then a fee is payable, equal to 1% of the amount of the new mortgage which may exceed the amount of the mortgage being cancelled or the sum of the amount of the mortgages being cancelled, excluding any accrued or non- accrued interest in each case. Where an existing mortgage or mortgages are terminated and on the same day, the mortgagee creates a new mortgage, on the same property or properties, for the same purpose, either with the same or another mortgagor, then a fee is payable equal to 1% of the amount of the new mortgage which may exceed the amount of the mortgage cancelled or the sum of the amount of the mortgages cancelled, excluding any accrued or non- accrued interest in each case. No fee payable in cases of cancellation and registration of a new mortgage for the same purpose: Where an existing mortgage or mortgages are terminated and on the same day the mortgagee creates a new mortgage for the same purpose, with the same mortgagor, but in respect of another property or properties, and the amount of the new mortgage, excluding any accrued or non-accrued interest in either case, is the same as or less than the amount of the mortgage terminated or the sum of the amount of the mortgages terminated. Where an existing mortgage or mortgages are cancelled and on the same day the mortgagee creates a new mortgage for the same purpose on the same property or properties either with the same or another mortgagor, and the amount of the new mortgage, excluding any accrued or non-accrued interest in either case, is the same as or less than the amount of the mortgage cancelled or the sum of the amount of the mortgages cancelled. In addition, there is a charge for the issuance of two (2) Mortgage Registration Certificates, each of which costs €5.00 |
