COMPULSORY SALE OF MORTGAGED PROPERTY BY COURT ORDER
Who can apply:
Any mortgagee may first apply to the Court and obtain an order of sale of the mortgaged properties instead of serving a notice accompanied by a statement of account upon the mortgagor and then apply for the sale of the property.
Required Documents / Conditions / Samples:
- Application for sale using the form Δ.Ε.176, stating the documents attached and, where applicable, the amount paid since the date of the judgment up to the date of the application
- True copy of the Court judgment or order
- Certificate of Registration of the Mortgage
How to submit:
Acceptance of the application is made at the District Lands Office where the property is located

Note: In the course of the application process, additional fees are requested in connection to the application (fees for the auctioneer, notices to all interested parties, sale notices, the president of the Community Council, the auctioneer's travel expenses) |
